2A. One-Off Services: Cancellation & Refunds

This section covers one-off website builds, engineering sprints, strategy calls, architecture blueprints and Kyrvyn HQ turnkey setup services. These are services, not standalone digital downloads. Your agreed scope, price and milestones remain set out in your order or Statement of Work (SOW).

• Consumer or business purchase: You are a consumer if you are an individual buying wholly or mainly outside your trade, business, craft or profession. The statutory cooling-off right below applies to consumers buying online, by phone or otherwise at a distance, or away from our business premises. Business purchases do not have this statutory 14-day cooling-off right.
• Consumer cooling-off period: You may cancel without giving a reason until the end of 14 days after the day the service contract is made. If we have not started work, we will refund all payments for the cancelled service. If we have not supplied the legally required cancellation information, your cancellation period may be extended by law.
• Starting work early: To start work or hold a call during that period, we must first obtain your express request to start early and your acknowledgement that your cooling-off right will be lost only once the service is fully performed. Accepting these Terms or paying alone is not that request. Otherwise, we will wait until the cancellation period ends before starting. This also applies to fast-turnaround services.
• Cancelling after an early start: If you cancel within the cooling-off period after properly requesting an early start, you pay only for the service supplied up to the time you tell us you are cancelling, in proportion to the full agreed service and price (or its market value if that price is excessive). We will explain the calculation and refund the balance. You owe nothing for work supplied during that period without your express request or without the legally required cancellation and cost information. Your cooling-off right ends on full performance only if you gave the request and acknowledgement described above. This does not remove your rights if the service is faulty.
• Other cancellations: For business purchases, or after a consumer's cooling-off right has ended, cancellation follows the SOW or booking terms agreed before purchase. If no separate cancellation terms were agreed, you may cancel work that has not been completed: we charge only for work actually completed and any reasonable, non-recoverable third-party costs you approved in advance, without double-counting and up to the agreed contract price. We will explain the charges and refund any unused balance within 14 days. This is not a blanket non-refundable deposit policy.
• Strategy calls: You may reschedule your strategy call free of charge by giving at least 24 hours' notice before its scheduled start. Contact us at contact@kyrvynltd.co.uk to arrange a new available time. If you give less notice or miss a call, contact us to discuss your options; this section does not introduce a missed-call or late-rescheduling charge. Consumer cancellation rights take priority over this booking policy.
• If we cancel or the service falls short: If we cannot provide the agreed service, we will refund the part not supplied. Consumer services must be performed with reasonable care and skill. Where the law requires, you may require repeat performance at no extra cost, within a reasonable time and without significant inconvenience, or an appropriate price reduction, which may be a full refund. These cancellation terms do not limit those rights or other remedies available by law.
• How to cancel and receive a refund: Email contact@kyrvynltd.co.uk or write to Kyrvyn Ltd, 15 Exning Road, London, E16 4NB, United Kingdom, with a clear statement that you wish to cancel. Include your order details so we can identify it. You may use the optional form below, but do not have to. Sending your cancellation before the statutory deadline is sufficient. Cooling-off refunds are made without undue delay and within 14 days after you tell us you are cancelling, using the original payment method unless you expressly agree otherwise, with no refund fee. Where a statutory service price-reduction refund is due, the 14 days run from when we agree you are entitled to it.

3. Digital Products, E-Commerce & Consumer Rights (CCR 2013 & CRA 2015)

When you purchase digital products, software engines, or service packages via our Digital Store:

• Digital Content Cancellation: For digital downloads and standalone repository access, consumers normally have a 14-day cooling-off period. Under Regulation 37 of the Consumer Contracts Regulations 2013, that right is lost when supply begins only if you have first given express consent to immediate supply, acknowledged that you will lose the right to cancel, and we have provided the required confirmation in a form you can keep, such as email. Accepting these Terms or placing an order alone does not provide that consent. This digital-content rule does not replace the service cancellation rules in section 2A, including for Kyrvyn HQ turnkey setup. Your rights for faulty digital content remain unaffected.
• Quality & Fitness for Purpose: In accordance with the Consumer Rights Act 2015, all digital content is warranted to be of satisfactory quality, fit for its declared technical purpose, and as described in our product specifications.
• Defect Rectification & Refunds: If digital content is defective or contains critical unresolvable bugs preventing execution, we will supply a repaired version or replacement within 48 hours. If the defect cannot be remedied, you are entitled to a full or partial refund.
• Monthly Retainers: Ongoing care and maintenance retainer subscriptions may be cancelled with 30 days written notice to contact@kyrvynltd.co.uk.
• The 30-day retainer notice does not restrict any statutory consumer cooling-off right or other right to end a contract provided by law. The consumer early-start and cooling-off refund rules in section 2A also apply to retainer services where required by law.
• Pricing & Currency: All prices are displayed in Pounds Sterling (GBP, £). Kyrvyn Ltd is not currently registered for UK VAT; prices are not subject to VAT surcharges.
